News August 28, 2007 - Grupo Fertinal of Mexico has secured funding from a silent partner to restart production at its 1m tonne/year phosphate fertilizer plant at Lazaro Cardenas, an industry source said on Tuesday.  The name of the investor was disclosed, but the source said it was believed to be a European company.  Fertinal was expected to start up the plant in January and have some product available from February. Fertinal can produce diammonium phosphate (DAP) and mono-ammonium phosphate (MAP) at Lazaro Cardenas.  The loading terminal for the facility was being rebuilt and was expected to be completed by 1 October.  Fertinal will use phosphate rock from its Rofomex mines in the Mexican state of Baja California Sur, as it was doing before Hurricane Juliette led to the idling of the plant in 2001.   The company is expected to crush 2m tonnes/year of rock.
For ammonia supply, Fertinal was understood to be talking with Yara for a long-term contract starting in November this year, according to sources. However, the company may also source some ammonia from local producer Petroleos Mexicanos (Pemex) at Cosoleacaque and may just be discussing some flexibility in the contract.  Fertinal would likely need 250,000 tonnes/year of ammonia if it produces DAP at full rate, according to sources.  Fertinal has already agreed to take three spot cargoes from Yara for September-November delivery from Trinidad to produce industrial grade ammonium nitrate at the site.
The supply of sulphur to the plant was an outstanding issue. Fertinal has contacted all the usual suppliers but has failed to reach agreement yet, as a result of a tight market, sources said.  Fertinal will likely need 400,000-450,000 tonnes/year of sulphur, sources said, and may take small quantities of liquid sulphur from local producer PMI/Pemex.

May 17, 2007 - Dutch financial services company ING Groep said Wednesday that a court has ordered its Mexican subsidiary to pay over $94 million in a claims dispute with mining company Grupo Fertinal.  In a press release, ING said a Mexican federal appellate court has awarded Fertinal about $94 million plus interest under an insurance policy with Seguros ING.   ING said the court's decision was the final ruling in the case, and that the settlement is "adequately covered by provisions taken" and reinsurance coverage.  ING has been involved in a protracted legal battle with Fertinal for several years over insurance claims stemming from damage to mining installations caused by Hurricane Juliette in 2001.  The final ruling affirms a lower court's decision in December 2005 to award $94 million to Fertinal, which had originally demanded compensation of $300 million.  ING argued at the time that it should only have to pay $13 million under its insurance contract with the mining company.
